Terms and Conditions for SongByrd

1. Acceptance of Terms

By downloading, accessing, or using the SongByrd mobile application (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

2. The Service

SongByrd is a premium mobile app that acts as a "song listening companion." It uses AI to provide deep, insightful, and engaging content about songs. The content provided is for personal, non-commercial, informational, and entertainment purposes only.

3. User Accounts

To access the full features of the Service after the initial free usage period, you must create an account. You are responsible for safeguarding your account information and for all activities that occur under your account.

4. Subscriptions and Free Trial

  • Metered Free Access: New users may analyze up to three (3) songs for free without an account.

  • Free Trial & Subscription: To continue using the Service after the third analysis, you must create an account and start a subscription. After the trial period, your subscription will automatically renew on a monthly or annual basis, depending on the plan you select.

  • Billing: All payments are processed through the Apple App Store or Google Play Store. You must have a valid payment method associated with your store account.

  • Cancellation: You can cancel your free trial or subscription at any time through your Apple App Store or Google Play Store account settings. You must cancel at least 24 hours before the end of the current billing period to avoid being charged for the next period.

5. Acceptable Use

You agree not to misuse the Service. This includes, but is not limited to:

  • Reverse-engineering, decompiling, or attempting to extract the source code of the app.

  • Scraping or bulk-downloading content from the Service.

  • Using the Service for any illegal or unauthorized purpose.

6. Intellectual Property

The Service and its original content (excluding third-party materials like album art), features, and functionality are and will remain the exclusive property of SongByrd and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for personal use according to these Terms.

7. Third-Party Links & Services

Our Service includes features that link to third-party websites and services, such as Spotify, Apple Music, Instagram, and TikTok. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

8. Disclaimers and Limitation of Liability

  • AI Content Disclaimer: The content generated by our AI is for informational and entertainment purposes only. While we strive for accuracy, the analysis may contain errors or inaccuracies. We do not guarantee the correctness of any information provided by the Service.

  • Service "As Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

10. Governing Law

These Terms shall be governed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any changes by updating the "Last Updated" date of these Terms within the app.
